Safeguards to Protect the Privacy of Protected Health Information

The Health Center will establish appropriate administrative, technical and physical safeguards to protect the privacy of protected health information. [§ 164.530(c)(1)]

Procedure:

  1. Purpose. The Health Center will reasonably safeguard protected health information from any intentional and unintentional use or disclosure in violation of the Health Center’s privacy policies and procedures, the Privacy Rule’s standards, implementation specifications or other requirements, and other applicable privacy laws.  [§ 164.530(c)(2)(i)]  Further, the Health Center will reasonably safeguard protected health information to limit incidental uses or disclosures made pursuant to an otherwise permitted or required use or disclosure.  [§ 164.530(c)(2)(ii)]
  2. Methods. The Health Center will use the following types of safeguards for protecting the privacy of protected health information:
  • a) Administrative safeguards.  These include, but are not limited to:
    • policies and procedures relating to the use and disclosure of protected health information by members of the Health Center’s workforce, other providers of health care services and business associates.
    • training and education on these privacy policies and procedures.
    • designation of workforce categories that identify the level of access to protected health information that is necessary and appropriate for workforce members to perform their Health Center functions.
  • b) Technical safeguards. These include, but are not limited to:
    • use of computer log-in names and passwords to limit access to electronic records and other controls that give access based on degree of necessary and appropriate access.
    • maintenance of appropriate electronic storage, back-up and destruction systems.
    • maintenance of all computer systems in compliance with security requirements applicable to protected health information .
  • c) Physical Safeguards. These include, but are not limited to:
    • locked medical record storage units.
    • an office environment that is secure from unauthorized individuals for areas where hard copies of protected health information are used.
    • appropriate protection from fire or water damage.
